USNH processes copyright complaints in accordance with the "Digital Millennium Copyright Act" or "DMCA." For general information related to USNH's DMCA policies, please visit https://td.usnh.edu/TDClient/KB/ArticleDet?ID=601.

In the event that USNH receives a complaint from a copyright holder, which generally only identifies an IP address, USNH identifies who was using that address and notifies the user via email. At no point in this process is the name of the user provided to the complainant short of a court order.

Early Settlement/Pre-Litigation Letters:

Some copyright holders will choose to address copyright infringement by the use of "early settlement" or "pre-litigation" letters. In these cases they offer the user a change to avoid litigation by settling ahead of time, generally for some level of cash settlement. USNH involvement in this process is limited to relaying the letter to the user. Again, USNH does *not* provide identifying information to the complaining party without a court order.

USNH IT strongly recommends consulting legal counsel in these cases. Legal services are available to most students via Legal Services in the Memorial Union Building (http://www.unh.edu/student-senate/legal_services.html.)

Escalation:

In the event that USNH receives repeated complaints about the same user, there is a system of escalating intervention in place to address chronic issues.

Disciplinary Action:

In certain cases, generally involving materials which violate USNH Policy, appropriate disciplinary units with be brought in to investigate the matter.
